Fair and Accurate Credit
Transaction Act (FACTA) |
|
An amendment to the FCRA
(see above), "The Fair
and Accurate Credit
Transaction Act" (known
as FACTA) is designed to
"to prevent identity
theft, improve
resolution of consumer
disputes, improve the
accuracy of consumer
records, make
improvements in the use
of, and consumer access
to, credit information,
and for other purposes."
Implemented on June 1st,
2005, the "Disposal
Rule,"
requires that, "any
person and/or business
who maintains or
otherwise possesses
consumer information for
a business purpose must
properly dispose of such
information using
reasonable measures to
protect against
unauthorized access to
or use of the
information in
connection with its
disposal," thereby
reducing the risk of
consumer fraud and
identity theft.
BackgroundsUSA
implemented a system 7
years ago whereby all
un-needed "waste"
documents containing
sensitive information
are consigned to
designated disposal
areas, and then shredded
to render them
unreadable. Documents
that we are required by
law to store for 2 to 4
years (depending on the
type of document and
nature of the
information recorded)
are kept in a secure and
locked facility, and
then are disposed of by
a FACTA compliant
disposal company, Bayaud
Industries Document
Destruction Services.
